I sell handmade jewelry through Etsy and my own Shopify site. Revenue is small but growing. I keep seeing people say to form an LLC, but I'm not sure if it's really necessary for a home-based online shop. I don't have employees, just me. Worried about liability if a customer has an issue, but also don't want to pay fees for nothing. Any thoughts from people who've been here?
I run an online store from home, is an LLC necessary?
If you have any personal assets worth protecting, an LLC is probably worth it. A customer could claim an allergic reaction to your jewelry materials. Without an LLC, your personal savings and home could be exposed. The annual fee in most states is a few hundred dollars.
I looked into this for my candle shop. The main thing is separating business and personal finances. Even with an LLC, if you mix money, you lose the protection. So you'd need a separate bank account. That part is easy, but the paperwork never ends.
Depends on your state. Some states have high annual fees. In California it's $800 minimum. That's a lot for a small Etsy shop.
Also consider an umbrella insurance policy. It might be cheaper and simpler than an LLC for a home business. I have one for my freelance work. Covers general liability without the state filing requirements.
Umbrella policies usually sit on top of existing homee or auto insurance. They may not cover business activities unless explicitly added. Worth checking with an agent.
Spruce hollow, did you need a separate rider? I looked into it and my insurance said they wouldn't cover anything business-related under the umbrella unless it was listed. Got complicated.
Yeah, I had to add a business endorsement. It raised the premium but still less than filing and maintaining an LLC in my state. But every policy is different.
Are you making jewelry with metal or just beads? Metalwork with a torch could be a fire hazard. That's a whole other liability. If you're just stringing beads, maybe less risk. But an LLC still separates your name from the business.
I've been selling online for 6 years without one. I just have good product liability insurance. No issues. But my business is low risk. I would say if you sell anything that goes on skin or in a mouth, LLC might be smart.
It's not just insurance. An LLC can help with taxes too. You can elect S-corp status later if profits grow. But that's more paperwork and payroll requirements. Probably overkill for now.
The piece people miss is the privacy aspect. If you register an LLC in your name, your home address can show up on public records. You can use a registered agent to avoid that. That costs extra. For me that was the deciding factor.
If you don't have any debt or significant assets, maybe wait. But as soon as your shop holds inventory or you sign a lease for a studio, it changes. Also think about your business name. If you want to trademark it later, having an LLC can look more professional. Not required, but cleaner.
Fair point about inventory. I hadn't thought of that.
So the umbrella insurance route sounds like it might cover me for now, but I need to make sure my insurer knows I sell online. I'm going to call them tomorrow. The $800 California fee is a big deterrent, but I'm in Texas so I think it's lower. Still need to run the numbers. The separate bank account thing I already do, not for legal reasons, just to keep track of spending.
