Working from home and deducting part of the rent

Quick question for anyone who's been through this: I run my one-person biz from my apartment and my accountant mentioned I might be able to claim a portion of my rent. The problem is our lease doesn't say anything about home office use. Is that a dealbreaker, or do people just... do it? I don't want to wave a red flag at my landlord.

bananapancake

depends where you are. in the US you generally don't need landlord permission for a home office deduction, you just need the space to be exclusively used for work. but I am not a CPA so grain of salt.

wired_mongoose

Your lease not mentioning it is pretty normal. Most leases are boilerplate. The deduction questi on and the lease question are kind of two separate things.

"just do it" is how audits are born lol. measure the square footage of your dedicated office, keep records, and don't claim a desk that's also your dinner table.

TinfoilCactus

Yeah to be clear I'm not trying to be sketchy — I have a real spare room that's only used as an office. Just didn't know if the lease clause was a hidden landmine. wired_mongoose that's reassuring.

pluto_is_a_planet

TinfoilCactus if the room is truly exclusive you're probably fine. the bigger question is whether your landlord's mortgage/insurance cares, and honestly that's on the landlord not you.

wired_mongoose

One thing nobody mentionned: if you rent, some jurisdictions calculate the deduction differently than if you own. Your accountant should know the local formula — percentage of square footage times rent. Simple in theory, annoying in practice.

I triecd this two years ago and my tax software got real passive-aggressive about it. Ended up just claiming a smaller percentage than I probably could have. Not worth the stress for me.

bananapancake

the software doesn't care, it's just badly worded prompts. don't let TurboTax shame you out of a legitimate deduction.

thriftstorepoet

SoggyNachos same energy as the software asking "are you SURE this isn't personal use???" eleven times. Anyway, photograph the room, keep a floor plan, and you're coverd.

GrumpyOtter

Wait, this is deductible? I've been writing off nothing and just eating the rent. Following.

pluto_is_a_planet

GrumpyOtter it's one of those things where the people who know are very loud and the people who don't just quietly lose money. Welcome to the loud side.

TinfoilCactus

Ok this has been genuinely helpful, thanks all. I'll bring the square footage and a photo of the room to my accountant and let them do the math. GrumpyOtter good luck, apparently we've both been leaving money on the table.

wired_mongoose

One last thing — check whether your lease has a "no business activity" clause separate from the office stuff. Some do, and that's the part that actually gets people in trouble with landlords, not the tax form.

SoggyNachos

And if it does, most landlords won't care about a quiet laptop job anyway. Just don't put a sign on the door and you're fine.
