Spent three months on a name for my new coffee roasting business. Had everything designed, domain bought, social handles claimed. Then a lawyer letter shows up. Turns out a roaster two states over has a near-identical name and registered it years ago. I'm not fighting it. Starting over on the name and I'm honestly just defeated. Anyone been through this? How do you get past the feeling that the new name is just a consolation prize?
I had to come up with a completely different business name
Not the same situation but i renamed my catering company after two years because the original name confused everyone. The new one felt wrong for about a month and then it just became normal. The name matters less than you think once customers attach it to a good product.
Did you do a proper trademark search before the first name? Not trying to pile on, genuinely asking, because I'm about to name something myself and I keep hearing these stories.
I did a basic search but clearly not a thorough one. Learned my lesson the expensive way.
The consolation prize feeling fades. What helped me was treating the second name as a chance to fix things I didn't love about the first one. Shorter, easier to spell, whatever. You get a do-over most people don't get.
How close was it? If it's just similar and not identical you might have options, but honestly if they registered it first you're probably right to walk away. Legal costs would eat a small roaster alive.
Three months is a long time to sit with a name. That's the hard part, the sunk cost. Give yourself a week to be annoyed about it, and then start fresh. Also check the USPTO database yourself before you pay anyone, it's free and not that hard to read.
Different angle but I'd say don't rush the second name just because you're tried. That's how people end up with something they resent. Take the time again.
That's my worry exactly. I'm so done with the process that I'm tempted to just pick something and move on, and I know that's a bad idea.
What was the first name, if you don't mind sharing? Might help people here suggest alternatives or at least tell you what was working about it.
Also worth checking state-level registrations, not just federal. That's where a lot of small conflicts hide. I found one that way that never would have shown up in a national search.
Seconding the state thing. And check the actual website of anyone with a sivmilar name, not just the registry. Sometimes they're operating without registering and you'd still rather know.
