I formed an LLC for my consulting work last year, and I operate out of my house in Phoenix. I'm getting mixed answers on whether I need a separate home-based business license from the city. Some people say the LLC covers it, others say no. Does anyone have firsthand experience with this? I'd rather not get fined for something stupid.
Does a Phoenix LLC need a separate license for a home-based business?
An LLC is a state-level entity. It doesn't replace city licensing. Phoenix requires a home occupation permit if you're running a business from a residential property. You should check the city's planning and development site.
What SaguaroSun said. I had to get a home occupation permit for my LLC a few years back. It was pretty straightforward but they did ask about parking and signage.
Honestly I've been running my LLC out of my apartment for two years and never got a selarate license. Maybe I'm just lucky? Or maybe it depends on the type of business. What kind of consulting?
It's not about luck, it's about whether anyone complains or whether you ever need to show proof for something like a bank loan or a commercial lease. The requirement exists regardless.
I'm not in Phoenix but I lurk here because I'm thinking of moving. In my city the home occupation permit is separate from the LLC and they're pretty strict about client visits. Does Phoenix limit how many clients can come to your house?
They do have limits on foot traffic and employees. I think it's something like no more than one or two non-resident employees, and the business cant change the residential character of the neighborhood. Vague language but they enforce it if neighbors complain.
That's probably why I've been fine. I do everything remote, no clients ever come to my place. But now I'm wondering if I should just get the permit anyiway to be safe.
Getting it is cheaper than a fine. Also check if your HOA has rules, they can be stricter than the city.
Also worth noting that if you're selling goods rather than services, there might be a separate transaction privilege tax license through the state. That's a different thing from the city home occupation permit though.
