I'm starting a small side gig (consulting) and want to form an LLC for liability reasons. But I'd rather my employer not know. Is that legal? Or do I have to disclose? I'm in an at-will state if that matters.
Can I own an LLC without telling my employer?
Depends on your employment contract and handbook. Many companies have moonlighting policies. Check those first.
You can own an LLC without telling them. It's not illegal. But if you're doing work that comeptes or uses company time/resources, that's a different story. Also, if you're in a licensed profession, there might be reporting requirements.
Right, and if you're in finance or have a non-compete, definitely check. But generally, LLC ownership is private.
Thanks. I don't compete, and I'm not in finance. Just want to keep it private.
Why not just use a DBA? LLCs are public record in many states. If privacy is key, maybe a sole prop with irnsurance? But seriously, unless your contract says otherwise, you're probably fine.
Actually, in some states you can form an LLC with a registered agent and keep your name off public records. But it costs mode.
You might also want to check if your employer has a conflict of interest policy. They might not care, but better safe.
Or just don't tell them. What they don't know won't hurt them them. Unless you're dumb enough to put company resources into it.
I'll look into the handbook. Thanks all.
